European Ombudsman Emily O'Reilly is right to re-open a procedure challenging the legitimacy of the endless three-way talks (Parliament-Commission-Council), which have become the norm in the EU's legislative process. Except for budgetary three-way talks, which remain relatively well regulated by the treaties, the informal three-way talks are still far too opaque - although the revision of internal rules at the European Parliament in 2013 has allowed for substantial changes: particularly the near-systematic adoption of negotiating mandates in plenary sessions.
